Terms of Service for our iOS App ("autoforward")

Please read these Terms of Service ("Terms") carefully before using the autoforward iOS application ("the App") operated by above the fold GmbH ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

autoforward is an iOS application that allows users to automatically forward incoming SMS messages to an email address or another phone number. The App relies on device capabilities and network connectivity to function.

2. No Warranty / Disclaimer

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that:

The App will be free of errors, bugs, or defects;
The App will function without interruptions;
Any defects in the App will be corrected;
The App will meet your specific requirements or expectations.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

3. Availability

We strive to maintain a reliable service, but we do not guarantee 100% availability of the App or its associated services. The App may be temporarily unavailable due to:

Scheduled or unscheduled maintenance;
Server outages or technical issues;
Network connectivity problems;
Factors beyond our reasonable control (force majeure).

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice.

4. Limitation of Liability

To the maximum extent permitted by applicable law, above the fold GmbH and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or messages;
Delays in message forwarding;
Service interruptions or downtime;
Any damages arising from the use or inability to use the App.

Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App (if any).

5. User Responsibilities

By using the App, you agree to:

Use the App only for lawful purposes and in compliance with all applicable laws and regulations;
Not use the App to send or forward spam, unsolicited messages, or any content that violates the rights of others;
Not attempt to interfere with, compromise, or disrupt the App or its servers;
Ensure that you have the necessary permissions and consents for forwarding messages.

6. Modifications to the Service and Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

We may also update, modify, or discontinue features of the App at any time without prior notice.

7. Intellectual Property

All content, trademarks, and intellectual property within the App are owned by above the fold GmbH or its licensors. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if we believe you have violated these Terms or are using the App in a manner that could harm us or other users.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts in Baden, Canton of Aargau, Switzerland.
